Terms and Conditions

These terms and conditions apply to all orders for delivery to the UK. Placing an order constitutes your acceptance thereof. Despatch of the products by us constitutes acceptance of the order by us and the commencement of our contract to supply. Your contract for supply is with Thompson & Morgan (a division of Branded Garden Products Ltd). Your statutory rights are not affected by any of these terms.

Our Commitment

Thompson & Morgan is committed to supplying high quality products to recreational gardeners and households for personal use and not for resale. In accordance with the established custom of the trade, Thompson & Morgan will in no case be liable for more than the actual amount paid for a particular item.

Availability

We will endeavour only to offer products which we expect to have in stock and available for ordering, but all items are subject to availability. Varieties that become unavailable will not be selectable on our website. Should a specific variety not be available at the time of despatch, or if items are of unsuitable quality to send, we undertake to supply a variety of similar colour and habit, and of an equal or greater value or send the item when available. This excludes fragrance products. If we are unable to supply your chosen fragrance we will contact you for further instructions. If no suitable substitutes are available, we will send a credit. Should you for any reason (including being unhappy with product substitutions) wish to receive a refund, you must return the product immediately.

Delivery

For plants, bulbs, fruit and potatoes approximate delivery dates are detailed on their product pages and on order acknowledgements. While we will do our very best to make delivery within this timeframe, weather conditions and natural light levels can affect plant growth rates and therefore may cause delivery dates to vary. In the event that your order is likely to be delayed by over 2 weeks from the indicated delivery window, we will write to you and advise new delivery times. However, it is also possible that plants may be despatched earlier than indicated.

Most seed orders are shipped within 5 working days of receipt of order. Please see special comments below for delivery of Christmas Gifts, other Gifts Items and Fresh Flowers.

Special Conditions for Certain Items

Plants

We will ship your plants to you at the best time for planting. The sooner you can plant them after arrival, the more successful you will be. We recommend that you prepare your soil, planting beds or patio containers ahead of time so you are ready to plant, or pot on when your order arrives. Please ensure that you open the packaging immediately upon receipt, and carefully read through the instruction leaflet provided.

It is not uncommon for some discolouration of the foliage to take place while the plants are contained in the dark during transit, but rest assured that the plants will return to their normal, healthy colour within a few days. Similarly, if on opening the package the plants appear ‘limp’, simply stand them in water and they will soon revive. If after a couple of days the plants do not perk up, please bring the problem to our attention.

Each plant variety, or product, may be packed separately, so if you order several plant varieties or products, these are likely to arrive on different days. Each package will state the item enclosed on your address label. Please do not be alarmed if you do not receive your entire order on the same day.

We promise to supply you with vigorous, healthy products in prime condition. We only ask you to plant them according to the growing instructions provided to enable you to get the best possible performance from them. We do understand that when dealing with living plants, occasionally problems may arise despite our mutual best efforts. In these instances we ask you to draw the problems to our attention so that we may help wherever we can. However, if you have not followed the instructions provided and your plants or seedlings do not grow properly, while we may share your disappointment, we regret we cannot share your loss. We promise to do our job to the highest standards, and we rely on you to use your best endeavours to achieve the optimum results.

Cut Flowers, Potted Plants, Gifts and Fragrances

You will be asked to select a preferred delivery date when you place your order, however delivery on these dates cannot be guaranteed. You will be advised at the time of placing your order if your chosen delivery date is not possible. Some products may be offered with enhanced delivery services which will be made clear at the time of placing your order. Please note that not all products are available with all delivery services, or to all destinations. If several items have been ordered, whether to different or same addresses, these will be despatched separately and therefore not always arriving on the same day.

If the recipient of your gift is unlikely to be home to take delivery, we are happy to include a short message on the address label with instructions for the postman. E.g. if out please leave in porch etc. Please provide these special instructions at time of placing your order. Unfortunately we are not able to provide this service for any orders placed online. Please note that we cannot guarantee, nor be responsible for, non-compliance with your instructions. We cannot accept liability for non-delivery for reasons including: recipient not available; not collected from delivery agent; address not accessible.

Although we will always do our best to deliver on the date requested there will be occasions when this is not possible due to circumstances beyond our control, such as adverse weather conditions, Sundays or Public Holidays.

We will do our best to supply products as featured, but occasionally details such as colour, baskets, pots and decorations may vary from those illustrated.

Refunds are not usually available for personalised items. Refunds will not be issued for fragrances or chocolates unless returned unopened, in the original packaging. Free proof of postage can be obtained from your local post office at the time of returning your order. We will not accept liability for non-receipt of returned orders unless proof of postage is supplied. Refunds are only payable to the original purchaser of the gift.

Christmas Gifts

Goods will be despatched in good time to arrive between 4th and 24th December. We regret we cannot deliver on specific dates. If several items have been ordered, whether to different or same addresses, these will be despatched separately and therefore may not arrive on the same day.

We endeavour to ensure our stock levels are adequate for the anticipated demand. In exceptional circumstances, rather than disappoint you by not supplying a product, we will send a substitute of equal or higher value. If you are not happy with the substitute, it may be returned it to us immediately for a full refund. Please also include a covering note stating that you require a refund. We will endeavour to supply products as featured, but occasionally baskets, pots and decorations may vary from those illustrated.

If you or the recipient of your gift is unlikely to be at home to take delivery, we are happy to include a short message on the address label with instructions for the postman. E.g. If out, please leave in the porch etc. Please provide these special instructions when you place your order. Unfortunately we are not able to provide this service for any orders placed online.

Should any product which arrives after 17 December not be up to standard, we regret that we will be unable to despatch a replacement item until the first working week of January, subject to availability. Please note that no refund / replacement claims can be made after 31st January.

Should there be any damage to the gift, or if it does not meet your expectations for any reason, please advise us within 14 days of receipt. We will replace the product (subject to availability) or credit the purchase price. Refunds are only payable to the original purchaser of the gift.

We cannot accept responsibility for items that fail to grow due to extreme weather conditions, over- or under-watering, or which have not been cared for according to the easy-to-follow instructions supplied. Due to the nature of our Christmas Gifts products, we are only able to deliver them to addresses in the UK.

Distance Selling Regulations

In accordance with the Distance Selling Regulations, you have the right to cancel your order at any time up to 7 working days after receipt. Please note that this does NOT extend to perishable items including living plants, cut flowers, bulbs, potatoes, onion and garlic sets, bare root plants, fruit trees, or fruit plants. If you wish to cancel an order please contact our Customer Care department within 7 working days after receipt. You must take reasonable care of the goods whilst in your possession and they must be returned to us, promptly, at your cost. We can arrange collection of larger items, but you will be charged for this service at cost. We reserve the right to cancel any order.

Payment and Vouchers

We accept Visa and MasterCard credit/debit cards. If you wish to pay by cheque you will need to post your order to us. Please note that your account will be debited/cheque cashed on receipt of your order by us. If your card issuer or bank refuses to authorise payment to us, we will contact you for further instructions. We will not be liable for any resulting delay or non-delivery. Refunds are only payable to the purchaser of the goods.

Online vouchers and order codes are personal to each individual and any inappropriate use is fraud. We reserve the right to cancel any vouchers or order codes at any time. Please note that Vouchers cannot be used as a payment method for the purchase of more Gift Vouchers, in full or in part.

FREE Vouchers

Please note that when we offer FREE vouchers to the value specified, either in catalogues, in your order confirmation, or within your delivery of goods, each voucher will be a promotional voucher. Only one promotional voucher can be redeemed per order. They cannot be used in conjunction with any other promotional offers, although we reserve the right to allow use of promotional vouchers with specific other promotional offers should we wish to do so.

Prices

Prices reflect the latest prices for all products. However, we reserve the right to change prices at any time. All prices include VAT, if applicable.

If, in error, a product(s) has been priced inaccurately, either at unit level or through the activation of a promotion, we will not be liable to supply that item(s) to you at the inaccurate price. In such circumstances, we will notify you of the correct price and ask you to confirm or decline your order for the item(s) in question.

Endangered Species / Genetic Modification

We will not knowingly offer for sale endangered species harvested from the wild or any genetically modified products.

New and Exclusive

Where an item is defined as 'New' it is new to our range. Where an item is defined as 'Exclusive' it means that this item is believed to only be available in this form from us and our associated brands.

All rights, including copyright, in the content of our catalogues and web pages are owned or controlled by us. In accessing our web pages, you agree that you may only download the content for your own individual and non-commercial use. You are not permitted to copy, broadcast, download, store (in any medium) transmit, show or play in public, adapt or change in any way the content of our web pages for any other purpose without our prior written permission.

Third Party Information

We cannot be held responsible for material displayed on third party websites or any other written material. The only prices that apply for our products are those stated within our catalogues and website. We will not be bound to prices quoted by shopping directories or other media.

The telephone rate per minute to call our Customer Care team is the equivalent of BT’s average national rate and is not a so called “premium rate number”. However calls from mobiles & some networks may vary. Your order or enquiry will be dealt with in a friendly and efficient manner by our team of dedicated staff.

We promise to supply products in prime condition. If for any reason you are not 100% delighted upon receipt of your order, please advise us by email or in writing within 7 days and we will offer a replacement (subject to availability), or credit, or refund the purchase price. Please note that any manufactured goods (e.g. gardening sundries) must be returned if you require a refund. It would be helpful if photographic evidence is provided when requesting a refund or replacement.

Please advise us promptly as this allows a replacement to be sent (subject to availability) and to ensure you still have time to achieve total satisfaction from your purchases. If your plants show no signs of healthy growth after potting or planting, providing you followed exactly the instructions supplied, we will replace, credit or refund the purchase price if you notify us within 30 days of receipt of your order. If any item supplied in a dormant state (e.g. bulbs, bare root perennials) fails to flourish the next season, let us know and we will endeavour to replace the product at the appropriate time or credit or refund the purchase price. Any plant or bulb that fails to grow true to type will be replaced, credited or refunded.

In the unlikely event that you are not satisfied with your seed germination, please notify us within 30 days of the prescribed germination time (specified on the seed packet, catalogue or online product page) enclosing both the outer packet and inner foil sachet.

We cannot accept responsibility for items that fail to grow due to extreme weather conditions, over or under-watering, or which have not been cared for according to the easy-to-follow instructions supplied.

We offer many varieties throughout our catalogues which we believe are the best in their class. If you don't agree with us and want to claim a refund of your money, the following details must be supplied to us in writing: the variety you believe to be better, where it was planted, soil type, site (sun, partial shade etc), details of fertiliser / water-retaining gel used (if applicable) and the reasons why you feel our varieties are not the best. Any claim must be made by 30th September of the year in question.
