Thompson & Morgan (UK) Ltd ("T&M") Terms and Conditions

The terms and conditions specified on this page are specific to orders on our website and for delivery to the UK. Placing an order constitutes your voacceptance thereof. Your statutory rights are not affected by any of these terms.

Our Commitment

T&M is committed to supplying high quality products to recreational gardeners and households for personal use and not for resale. In accordance with the established custom of the trade, T&M will in no case be liable for more than the actual amount paid for a particular product on sale.

We will endeavour only to have products on our web site that are in stock and available for ordering. Varieties that are unavailable will be listed as such and will not be selectable. Should a specific variety not be available at the time of despatch, T&M will include a substitute where possible or send the item when stock becomes available. If no suitable substitutes are available, T&M will send a credit. Should there be a delay of more than 2 weeks with the delivery of your order, we will do our best to contact you with a revised delivery date.

Your contract will be with Thompson & Morgan (UK) Ltd, Poplar Lane, Ipswich, Suffolk, IP8 3BU, VAT Registration Number 637 8510 20 GB, Company Registration: 358372 England.

Despatch of the product by Thompson & Morgan (UK) Ltd constitutes the acceptance and commencement of our contract to supply.

Distance Selling Regulations

In accordance with the Distance Selling Regulations, you have the right to cancel your order at any time up to 7 working days after receipt. Please note that this does NOT extend to perishable items including living plants, cut flowers, bulbs, potatoes, onion and garlic sets, bare root plants, fruit trees, or fruit plants. If you wish to cancel an order please contact our Customer Care department within 7 working days after receipt. You must take reasonable care of the goods whilst in your possession and they must be returned to us, promptly, at your cost. We can arrange collection of larger items, but you will be charged for this service at cost. We reserve the right to cancel any order.

Payment

We accept Visa and MasterCard credit/debit cards for online orders. Please note that your account will be debited on receipt of order at T&M. If you wish to pay by cheque you will need to post your order to us.

If your card issuer or bank refuses to authorise payment to us, we will contact you for further instructions. We will not be liable for any resulting delay or non-delivery.

Refunds are only payable to the purchaser of the goods.

Online vouchers and order codes are personal to each individual and any inappropriate use is fraud. T&M reserves the right to cancel any vouchers or order codes at any time.

Vouchers can be redeemed over the telephone and online. Please visit our dedicated Help with Vouchers information page for more details on using both promotional vouchers and gift vouchers. When using order codes online please enter the order code in your shopping basket. Only one order code can be used per order online.

Prices

All prices are correct at the time of entering the information onto our web pages. However, T&M reserves the right to change prices at any time. All prices include VAT if applicable.

Most seed orders are shipped within 5 working days of receipt of order. For plants, bulbs, fruit and potatoes approximate delivery dates are detailed on their product pages and on your order acknowledgement. Unless otherwise stated all selling prices quoted are inclusive of reasonable postage and packing. We make a charge for picking and processing orders (P&P). All such P&P charges are shown separately and added automatically to your shopping basket.

Endangered Species

T&M will not knowingly offer for sale endangered species harvested from the wild or any genetically modified products.

Third Party Information

We cannot be held responsible for material displayed on third party websites or any other written material. The only prices that apply for T&M products are those stated within T&M catalogues and website. We are not able to vouch for the reliability of prices quoted by shopping directories or on other third party websites.

Receiving Your Plants Order

We will ship your plants to you at the best time for planting. The sooner you can plant them up after arrival, the more successful you will be. We recommend that you prepare your soil, planting beds or patio containers ahead of time so you are ready to plant, or pot on, just as soon as your order arrives. Please ensure that you open the packaging immediately upon receipt, and carefully read through the instruction leaflet provided.

Each plant variety, or product, will be packed separately, so if you order several plant varieties or products, these are likely to arrive on different days. Each package will state the item enclosed on the top line of your address label. Please do not be alarmed if you do not receive your entire order on the same day. When stocks are limited, we undertake to supply a variety of similar colour and habit and of an equal or greater value. In the event that you are not happy with the substitute variety we send, please contact our Customer Care team.

We strive to provide the best possible products and level of service we can, but we are all human and occasionally we may fall below our own high standards. Our experienced Customer Care staff are there to assist you if you do encounter problems. Their aim is to respond promptly and efficiently to all comments to ensure you receive 100% satisfaction at all times.

You can ring us on 0844 248 5383 from 9am to 8pm, Monday to Friday and 9am to 6pm Saturday and Sunday. Please note that these hours may vary during quiet periods and bank holidays. The charge rate per minute to call our Customer Care team is the equivalent of BT’s average national rate of 5p per minute. However calls from mobiles & some networks may vary. Our Personal Guarantee to You

We promise to supply products in prime condition. If for any reason you are not 100% delighted upon receipt of your order, please advise us by email or in writing within 14 days - this allows a replacement to be sent promptly to ensure you still have time to achieve total satisfaction from your purchases. In the unlikely event that you are not satisfied with your seed germination, please notify us within 30 days of the prescribed germination time (specified on the seed packet, catalogue or online product page) enclosing both the outer packet and inner foil sachet.

In exceptional circumstances, we will issue credit vouchers or a full refund for faulty goods. Our liability is restricted to the value of the goods ordered. We cannot accept responsibility for items which fail to grow due to extreme weather conditions, over- or under-watering, or which have not been cared for according to the easy-to-follow instructions supplied.

Our Shared Responsibility

We promise to supply you with vigorous, healthy products in prime condition. We only ask you to plant them according to the growing instructions provided to enable you to get the best possible performance from them. We do understand that when dealing with living plants, occasionally problems may arise despite our mutual best efforts. In these instances we ask you to draw the problems to our attention so that we may help wherever we can. However, if you have not followed the instructions provided and your plants or seedlings do not grow properly, while we may share your disappointment, we regret we cannot share your loss. We promise to do our job to the highest standards, and we rely on you to use your best endeavours to achieve the optimum results.

Money Back Guarantee on Specific Varieties - Best in Class

There are many varieties throughout our catalogues that we believe are the best in their class. If you don't agree with us and want to claim a refund of your money, the following details must be supplied to us in writing: the variety you believe to be better, where it was planted, soil type, site (sun, partial shade etc), details of fertilise/water-retaining gel used (if applicable), reasons why you feel our varieties are not the best. Any claim must be made by 30th September of the year in question.
